Online Sales - Terms & Conditions

You buy beer and use our website subject to these Terms and Conditions. The Terms may be subject to change from time to time and changes will be posted on this site. We are Breakwater Brewing Co LTD and we supply beers through the name, Breakwater. Our address is Breakwater, Lorne Road, Dover, Kent and company no.10189652. However we act as agent and you buy the beer from us or our partners.

If their terms and conditions also apply this will be shown on the website.

1.On sales and guarantees

1.1. Sales are on the basis of these terms and any terms of the relevant brewery details of which are supplied to you.
1.2. We are very careful to ensure good quality beers and we aim to keep customers satisfied. Where you ordered in bulk and feel you do not like the beer after tasting the first bottle, then we on behalf of the brewery which has sold you the beer are willing to give a refund on the whole bulk order provided that you return the unopened bottles of beer.
1.3. For a standard case, a delivery fee of £5.99 is charged. We also provide a complete list of delivery charges below. Please be reminded that we deliver only to a limited number of areas in UK. We provided a list of postcodes not covered by our delivery services below. Delivery schedule is from Monday to Friday from 7 am to 7 pm. You may leave instructions as to where to leave the ordered bottles of beer.
1.4. As we value customer satisfaction, we want to ensure that your orders will be delivered to you in good condition. Where the bottles delivered outside your house are stolen, please report them to Breakwater Brewery through e-mail or phone call within 1 week of expected delivery. If the beer is not in good condition such as broken bottles report this to us also within 1 week and we will give a refund on the damaged bottles on behalf of the brewery which has sold you the beer. This does not affect your statutory rights. For other questions regarding delivery, you may contact us through customerservices@breakwater.beer.
1.5. If ever you find that we do not adhere to these Terms and Conditions, then you may contact us through our call centre or e-mail us at customerservices@breakwater.beer.
1.6. We treat all comments and complaints in a professional way and respond to them quickly. You can expect our acknowledgement within 24 hours. Some cases will inevitably take more time to be resolved but we will endeavour to update you with the progress of your complaints. We also welcome suggestions on how we can improve our services. 1.7. We reserve the right to terminate our services to those who breach these terms.

2. Credit Card Statement, Prices and Payments

2.1. When you buy your payment will be displayed on your credit card bill as “Breakwater Bars” even though the purchase is from the brewery concerned and we act as agent. The price of beers, whether retail or per case, is in pounds sterling and inclusive of value added tax. Delivery charges are in addition but are clearly stated on this site.
2.2. We accept major credit cards such as Visa, Switch, Maestro and Mastercard.
2.3. We base our discounts on the regular price advertised in our website for 28 consecutive days in the past 6 months. For discounts applied to a set of different beers, the price is based on the regular price of the different beers included in the lot.

2.4. We reserve the right to withdraw our promotional offers at any time without notice.

2.5 Breakwater Brewery or Bars are not responsible for pricing, typographical, or other errors, on our website. 

3. On Selling to Minors

3.1. We and the breweries supplying the beer do not sell beers to anyone under 18 years old.
3.2. Where beer will be delivered as a gift, the recipient of the beer should also be 18 or over.

4. On Customer Protection

4.1. We use a secure server and do not disclose account details and credit card information to anyone save as is necessary to process your order and comply with these terms.
4.2. Customers are responsible for their own passwords. Do not disclose your passwords to anyone.

5. On Usage of Coupons or Vouchers

5.1. The following terms and conditions apply upon the usage of coupons:
a. Coupons are only valid for orders of 12 bottle cases or more, and in the taproom, provided they are included in the promotion. 
b. You must be 18 years or over to use coupons.
c. Coupons are non-convertible to cash and may not be sold.
d. Improper usage of coupons may result to additional charges on the payment card and possible recall of goods sold. The cost of recovering the goods will be borne by the customer.

6. On Cancellation of Orders

6.1. We acting on behalf of the breweries selling you the beer allow cancellations of orders provided cancellation is within 7 days after the receipt of the beers provided that the beers are in good condition, unopened and sealed as required by the Consumer Protection from Distance Selling Regulations 2000 (as amended).
6.2. To cancel orders, call us or email us at customerservices@breakwater.beer. You may also write a letter to us using the following mailing address:

6.3. Refunds will be made within 30 days from the date of cancellation. It is the customer’s responsibility to keep the bottles in good shape until they are collected. Collection charges apply.

7. On Returns

7.1. If you receive the bottles in a poor condition (e.g. broken bottles or spoiled beers), please inform us. We as agent for the brewery which sold you the beer can either give a refund on the whole purchase or in relation to the damaged bottles only.
7.2. Requests for returns should be made within 30 days after the beers are delivered. To do so, you may call or e-mail our customer service department. You may also write a letter to us using the same mailing address stated above.
7.3. Refunds will be given to the customer within 30 days after the beers have been delivered.
7.4. Customers who wish to return the beers purchased should retain the beers’ original packaging to ensure safe transport.
7.5. These terms and conditions do not affect your statutory rights. For further information on such rights speak to your Local Authority Trading Standards Department or Citizen's Advice Bureau.
7.6. Members of the 52 Week Beer Club will be informed of the status of their orders a week before the beers are shipped. You should cancel before the beers are shipped. If not you will have to pay the return delivery charge.

8. Intellectual Property Rights

8.1. You recognise our ownership of the copyright, product photography, database rights, trademarks and other intellectual property of ours in the Site and our material on the site and our trading name.
8.2. We do not allow anyone to put links to the Breakwater Brewery website from other unrelated websites without our permission.

9. Quality Assurance

9.1. We and people/businesses who sell you the beer aim to ensure that our beers are in good condition, kept in good condition and will reach you the customer in good condition.

10. Limitation of Liability and Force Majeure

10.1. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence nor for fraudulent misrepresentation.
10.2 Subject to clause 10.1 we exclude all liability for consequential loss, loss of profit, revenue and goodwill, loss or damage not anticipated when you agree these terms
10.3 We are not liable for damage caused by customer mishandling such as breakages and spillages.
10.4 Our responsibility to customers is only limited to the amount paid for the beer subject to clause 10.1.
10.5 The following warnings about alcoholic products should be noted:
a. Beer is a form of alcohol so it must be drunk moderately.
b. Extra care should be taken when transferring beer bottles. We recommend that you transfer them no more than two bottles at a time to avoid accidents.
c. Beers can cause stains so extra care should be taken to avoid spillage.
d. Beers are volatile so be careful when opening the bottles.
10.6 We are not liable for breach of this Agreement for any loss or liability arising from circumstances of force majeure and other circumstances beyond our reasonable control such as Act of God, Government regulation or order, fire, theft, flood, strike, riot, insurrection, war, national emergency, power shortage, pandemic, terrorist activity. Where one of the brewery supplies does not supply us with beer we are not liable for our failure as agent to continue to make that beer available for sale to you.

11. General

These terms are subject to English law and you and we accept the exclusive jurisdiction of the English courts in connection with any disputes. Headings are not to be used in the constructions of this Agreement. These terms and any document referred to in them are the entire agreement between us and may only be varied as stated in these terms or by agreement in writing. Our failure to enforce a right does not amount to waiver of it. You may not assign or transfer your agreement with us to any third party.

In House Beer Sales

The Breakwater Brewery Beer Club Membership Agreement

1. In order to become a member of the Breakwater Brewery Beer Club, you must be 18 years old.
2. Membership can either be through invitation or by paying an annual membership fee.
3. Members of the club are entitled to benefits found at the website of Breakwater Brewery. Breakwater Brewery reserves the right to revise the benefits of the membership on 30 days’ notice by email to the member and by notice on the site. The members have the right to terminate their membership before the changes take effect.
4. The following will only apply to those who sign up for membership at Breakwater Brewery Beer Club
a. As a member of the Club, you are entitled to receive a case of assorted beers every three months. You will receive 52 beers a year. These beers are sold to you by the breweries concerned and we act as their agent in the sale.
c. Where we terminate the club, we will continue to provide services and benefits to customers during the remaining months of membership for which you have paid, or provide a refund at our discretion.
d. It is the members’ responsibility to inform the Club of any changes to the delivery name and address or any other information significant to the processing of beer deliveries. You may call or e-mail us at club@breakwater.beer. The Club automatically delivers the beer cases to the address where the cases were previously delivered.
e. If you want to terminate your membership of the club, you may do so by calling or e-mailing our customer service department. You can also post a letter to us using the address stated above. If you decide to withdraw your membership during its term we will refund the portion of the membership fee which was not used for goods not yet despatched.
f. It is Breakwater Brewery’s right to accept or reject applications for membership and also to terminate an individual membership at any time. The member will be informed within 30 days.
g. Where we revise the Breakwater Brewery Beer Club’s Terms and Conditions, the members of the Club will be notified before their cases are shipped so as to give time for them to decide whether they wish to continue their membership to the Club.
i. Annually, there will be promotional shipments of cases. You will be notified of the details of this promotion and the corresponding price. It is in the member’s discretion whether to buy such products.

Social Media Competition Terms & Conditions

All entrants must be over the age of 18.  All competitions close at a specified date and time.   The number of winners will be specified in the competition outline.  Winners will be selected at random. Winners will be selected at random and contacted after the competition closes. 

Employees of the Breakwater and Brewery  and their immediate families, their agents or anyone professionally connected with the draw are not permitted to enter. Entry to the competition is free. Enter the competition via Twitter, Facebook or Instagram - depending on platform shared. No equivalent to the prizes, cash or otherwise will be offered. Enter the competition online. Only one prize can be won per entry. Privacy policy can be viewed online.

The result of the draw is final. No correspondence will be entered into. By entering the Free Prize Draw, the winner consents to any publicity generated as a result of the draw and use on websites, Facebook, social media platforms, magazines or mobile services at any time without further consent or payment. Competition winners must collect their prize from the Breakwater Taproom within 2 weeks of notification.    Gift vouchers as competition prizes are redeemable on the website, as well as taproom purchases.
The promoters of the competition are Breakwater Brewery & Taproom. The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or Instagram.
